Outlined Below is a sample catering contract that you can use for your business. 

State of Georgia

This Catering Services Agreement (“Agreement”) is effective as of ________ by and between:

  • XYZ Catering Company (“Caterer”), with a primary address at [Address], and

  • ABC Logistics (“Client”), with a primary address at [Address].

Both are referred to as “the Parties” and individually as “Party.”


Recitals

  • Client seeks to engage Caterer for specific catering services.

  • Caterer possesses the required expertise to deliver these services.

  • Both Parties agree to enter into this Catering Services Agreement to outline their mutual obligations.


Article 1 – Definitions

A) “Event” refers to the following catering service provided by the Caterer:

B) “Catering Services” includes the specific services provided by the Caterer:

Article 2 – Agreement to Provide Catering Services

Subject to the terms and conditions of this Agreement, Caterer agrees to provide the Catering Services as described above, utilizing all the Event Details as directed. Client agrees to pay the Caterer the Fees outlined for the Catering Services.


Article 3 – Menu for Catering Contract

The menu for the catering services shall include the following (“Menu”):
Starches: List starches here
Proteins: List proteins here
Veggies: List veggies here
Drinks: List drinks here
Other: List additional items if necessary

Caterer may make small changes to the Menu if certain ingredients cannot be sourced after reasonable efforts.


Article 4 – Staff for Catering Services

The Caterer will employ the following staff for the catering services, approved by the Client:

  • Number of Head Chefs: [Amount]

Article 5 – Payment and Fees

Article 7 – Cancellation of Catering Contract

Caterer shall comply with all local, state, and federal laws governing food preparation and service.


Article 9 – Warranties

Client agrees to indemnify the Caterer and its agents against any damage, liability, or loss related to the Catering Services rendered under this Agreement. Caterer will maintain general liability insurance during the Agreement’s term.


Article 12 – Termination of Catering Contract

This Agreement terminates at the conclusion of the event. Either Party may terminate the Agreement upon written notice if the other Party fails to perform its obligations.


Article 13 – General Provisions

  • Governing Law: This Agreement is governed by Georgia state laws.

  • Language: All communications under this Agreement will be in English.

  • Amendments: Any changes to this Agreement must be made in writing and signed by both Parties.

  • Force Majeure: The Caterer is not liable for failure to perform due to circumstances beyond its control.
